Privacy Policy
Effective date: November 25, 2025
This Privacy Policy explains how Chat-messenger (“Chat-messenger”, “we”, “us”, or “our”) collects, uses, shares and protects personal data when you use our websites, products and services (collectively, the “Services”). We are committed to handling your information in a lawful, fair and transparent way.
If you have any questions or concerns about this Policy, you can contact us at privacy@chat-messenger.com.
1. Who we are
Chat-messenger is a software platform that helps businesses and creators automate messaging on social and messaging channels such as Instagram, Facebook, WhatsApp and websites. When we decide how and why your personal data is processed, we act as a “data controller” under applicable data protection laws.
When our customers use the Services to communicate with their own subscribers, leads or customers, they are the controllers of that data. In such cases we act as their “data processor” and process data strictly on their instructions and in line with our agreements.
2. Scope of this Policy
This Privacy Policy applies to personal data we process about:
- visitors of our websites and landing pages,
- individuals who create or use a Chat-messenger account,
- newsletter subscribers and other potential customers who interact with our marketing,
- contacts of our suppliers, partners and other business relationships.
This Policy does not override specific contracts or data processing agreements we may have with customers. In case of conflict, those documents will prevail.
3. How we collect data
We collect personal data in several ways:
- Information you provide to us. For example, when you create an account, sign in, fill out a form, subscribe to a newsletter, request support, or communicate with us in any way.
- Information we collect automatically. When you visit our websites or use the Services, we may automatically collect technical data about your device and usage (such as IP address, browser type, pages visited, clicks and time spent).
- Information we receive from third parties. We may receive information about you from social networks and messaging platforms you connect to Chat-messenger, from payment processors, or from marketing and analytics providers, always in accordance with applicable law.
4. Types of data we process
Depending on how you interact with our Services, we may process the following categories of data:
- Account and profile information. Name, email address, password (stored in encrypted form), role or job title, company name, country, preferred language and other data you add to your profile.
- Contact and business information. Name, email, phone number, social media handles, organization and other professional details when you communicate with us or become our customer or partner.
- Customer content and subscriber data. Any information that you or your team import or collect via Chat-messenger, such as subscriber identifiers, tags, segments, messaging history and events associated with those contacts.
- Usage and technical data. Log data (such as IP address, device type, operating system, browser), pages viewed, features used, timestamps, error logs and performance metrics.
- Billing and payment data. Billing name and address, VAT or tax numbers, subscription plan details and the last digits or tokenized version of payment cards. Full card details are typically handled directly by our payment processors.
- Marketing and communication preferences. Data about your subscription to our marketing emails, your preferences, and whether you open or interact with our messages.
We do not intentionally seek to collect sensitive categories of data (such as health information, political opinions, religious beliefs or similar). Please avoid sharing such information through the Services unless strictly necessary and legally permitted.
5. How we use personal data
We use personal data for the following purposes and on the legal bases described below:
- Providing and maintaining the Services. To create and manage accounts, provide features, process messages, troubleshoot issues, and ensure the Services operate securely and reliably.
- Customer support. To respond to your questions, requests and feedback, and to provide technical and account support.
- Improving the Services. To analyze usage patterns, understand how the Services are used, and develop new features and enhancements. Where possible, we use aggregated or de-identified data for analytics.
- Marketing and communications. With your consent where required by law, we may send you product updates, tips, offers and newsletters. You can opt out at any time by following the unsubscribe link in our emails.
- Security and fraud prevention. To detect, investigate and prevent fraudulent or malicious activity, to protect the security of the Services, and to enforce our terms and policies.
- Legal compliance. To comply with legal obligations, regulatory requirements, court orders or other lawful requests from authorities.
We process personal data only when we have a valid legal basis, such as your consent, the performance of a contract, our legitimate interests, or compliance with law.
6. How we share personal data
We do not sell your personal data. We may share personal data in the following situations:
- Service providers. We engage trusted third-party providers to help us operate and improve the Services (for example, hosting, email delivery, analytics, payment processing, customer support). They may only process personal data on our instructions and must protect it appropriately.
- Integrated platforms. When you connect social or messaging platforms (such as Instagram, Facebook, WhatsApp) or other tools to Chat-messenger, we share data as required to operate those integrations, based on the settings you configure.
- Professional advisors. We may share data with legal, tax, financial or security advisors when this is necessary to obtain professional advice or protect our rights.
- Business transfers. If Chat-messenger is involved in a merger, acquisition, reorganization, bankruptcy or sale of some or all of our assets, personal data may be transferred as part of that transaction, subject to appropriate safeguards.
- Legal and safety reasons. We may disclose data when we believe in good faith that doing so is reasonably necessary to comply with a legal obligation, protect the rights, property or safety of Chat-messenger, our users or others, or prevent fraud or security issues.
We may also share aggregated or de-identified information that does not reasonably identify any individual.
7. Your rights
Depending on where you live and the applicable laws, you may have some or all of the following rights regarding your personal data:
- the right to request access to the personal data we hold about you;
- the right to request correction of inaccurate or incomplete data;
- the right to request deletion of your personal data in certain circumstances;
- the right to object to or restrict certain processing activities;
- the right to withdraw consent where processing is based on your consent;
- the right to data portability, where applicable.
You can exercise some of these rights directly in your Chat-messenger account (for example, by updating your profile or closing your account). You can also contact us at privacy@chat-messenger.com with your request. We may ask you to verify your identity before responding, and we will answer in accordance with applicable law.
When we process data on behalf of a customer, we may not be able to respond to your request directly. In that case, we will typically refer you to the relevant customer (the “controller”), who is responsible for handling such requests.
8. Data retention
We retain personal data for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or allowed by law (for example, for tax, accounting, legal or security reasons).
When your account becomes inactive or is closed, we will delete or anonymize personal data within a reasonable period, subject to any legal obligations to retain certain information.
9. International transfers
Chat-messenger may store and process personal data in countries other than your own. These countries may have different data protection laws. Where required by law, we implement appropriate safeguards to protect international data transfers, such as standard contractual clauses or equivalent mechanisms.
10. Children’s privacy
Our Services are not directed to children under the age of 16, and we do not knowingly collect personal data from children under 16. If we become aware that such data has been collected, we will take steps to delete it as soon as reasonably possible.
11. Security
We use reasonable technical and organizational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Changes to this Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “Effective date” at the top of this page and, where appropriate, provide additional notice (for example, by email or in-app notification).
We encourage you to review this Policy periodically to stay informed about how we handle your personal data.
